This Privacy Policy (the “Policy”) serves to inform you Simplicity AI, Inc.’s, a Delaware corporation headquartered in New York, New York, policies and procedures regarding the collection, use, and disclosure of the data and information we receive when you access and use the Simplicity mobile application (the “App”) or Simplicity’s services, software, content, or other products and services (collectively, the “Services”).

PLEASE READ THIS POLICY CAREFULLY. IT IS IN CONJUNCTION WITH OUR TERMS OF SERVICE (THE “TERMS”). THIS POLICY AND THE TERMS ARE PART OF THE LEGAL AGREEMENT BETWEEN YOU AND US. 

YOUR CONSENT. BY TAPPING “I AGREE”, REGISTERING FOR AN ACCOUNT, OR USING OUR MOBILE APPLICATION, ACCESSING OUR WEBSITE, OR USING ANY OF OUR PRODUCTS AND SERVICES, YOU CONSENT AND AGREE TO BE BOUND BY THE POLICY AND THE TERMS WHEN YOU USE THE APP OR SERVICES, OR WHEN YOU SIGN UP AND CREATE AND ACCOUNT. YOUR CONSENT INCLUDES THE COLLECTION AND USE OF THE INFORMATION AND DATA SET FORTH IN THIS POLICY AND THE TERMS. IF YOU DO NOT AGREE TO OUR POLICY AND TERMS, PLEASE DO NOT USE OR INSTALL OUR APP, OR USE OUR WEBSITE OR ANY OF OUR PRODUCTS AND SERVICES. YOU MAY WITHDRAW YOUR CONSENT AT ANY TIME (SEE SECTION 7 BELOW AS TO YOUR RIGHTS AND CHOICES).

We may modify this Policy at any time at our sole discretion. If we make revisions, We will revise the “Last Updated” date at the top of this page, and the revised version will be effective immediately when it is posted. If We make material changes, We may also notify You through an in-app notice, but You should neither expect nor rely on an in-app notice. We encourage You to review this Policy regularly to stay informed about our information practices and the choices available to You.

As used in this Policy,  “We,” “Our,” and “Us” refer to Simplicity AI, Inc.; “You” and “Your” refers to the person using Our App and/or any Service; “App” refers to the mobile application, software, processes, tools, and features, and the manner and process by which You communicate and share information with Us and with others through or using the App.

1. Information We Collect

We receive information from You directly when You provide it to Us, automatically, or from other, third-party sources. We use the information to provide and to improve our App and Services, administer your account, and enable You to use the features of the App. When You are asked to provide personal information, You have the right not to do so. However, please note that if You choose not to provide Us with Your personal information when prompted, You may not be able to Use the App or our Services.

A. Information You Provide to Us

When you register or use the App, we collect the following information directly from you:

  1. Account Registration (Phone, Email & OTP): We do not use passwords for accounts. You must provide your mobile phone number or email to sign up. We use this to send you a One-Time Password (OTP) via text message or email to verify your identity and log you in.

  2. Profile Information: We collect your name and phone number, and You may be asked to provide an email address.

  3. User Content: To provide the core features of the App, we collect the content you choose to upload, save, or share, including:

    1. Photos: Images of items you upload, which may include photos of you or others.

    2. Saved Links: URLs and links to items (e.g., from online stores) that you want to save.

    3. Notes and Comments: Personal notes, feedback on items, and comments shared between you and other users regarding items you are considering buying.

  4. Payment Information: The App is currently free. However, we may introduce premium features in the future for which fees may apply. If you choose to purchase these features, we (or our third-party payment processors) will collect payment details necessary to process the transaction.

B. Automatically Collected Information

When You use the App or Services, your device may share with Us and We may automatically collect certain technical information to ensure the App functions correctly and to improve user experience:

  1. Device Data: Information such as Your device model, operating system version,  unique device identifiers automatically assigned to Your device.

  2. Usage Data: Details about your activity on the App, such as features used, pages accessed, time of day, time spent, and items viewed.

  3. Network Information: Internet Protocol (IP) addresses and general network data.

C. Information From Other Sources

We may receive data or personal information about You from other sources, such as social media accounts, third-parties You authorized to share information with Us, or third-party service providers used in connection with the App.

E. Data Collection and Analytics

We use Clear GIFs, Google Tags, and Pixel Tags (also known as web beacons) and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, and are embedded invisibly on web pages. A Google tag is a snippet of JavaScript code installed on a website or in an application that tracks behavior and campaign performance. Pixel Tags are a small piece of code embedded invisibly on a website to identify and track the user and user behavior. 

We use these technologies to monitor, track, and analyze the activities on the App, user behavior and data, and compile statistics about App usage and User Content. We further use these technologies to help us manage content, improve performance, introduce new features, and for marketing in general and to specific users. You understand and consent to Our use of such technologies.

E. Information We Do Not Collect

We do not collect, and the App is not designed to collect, DNA or biometric information (e.g., facial recognition data, fingerprints); race or ethnic origin; marital status; medical or health information; education or employment history; financial information; or identifying numbers (e.g., social security, passport, or driver’s license numbers). Uploaded User Content is not processed to extract biometric identifiers about you or any person depicted.

2. Use of Information

We use the information We receive for the following purposes:

To Provide the Services: To create and manage Your account, verify Your identity and phone number via OTP, store Your photos and links, and enable sharing with friends.

To Provide and Maintain the App: To operate and maintain the App, including diagnosing technical issues. 

Communications: To send You messages, security alerts, and updates regarding the Services.

Service Improvement: To improve the App and its functionality, to improve the user interface and experience,  to research and develop and implement new features or tools, and to analyze usage trends and preferences to improve the App.

Personalize Your Experience: To suggest items, features, or other information that You might like.

Customer Support: To communicate with You to respond to questions or provide support, and address and resolve technical issues.

Legal Compliance: When We determine in our discretion it is necessary for Us to comply with a legal requirement or to investigate and address reports of fraud or criminal activity.

Future Premium Features: To process payments and administer premium accounts should You choose to subscribe to future paid features.

3. Data Retention and Deletion

We are committed to giving You control over Your personal data and information. We retain data and information We receive only as long as reasonably necessary.

Account Deletion: You may delete Your account and all associated information at any time through the App or by signing into your account in a browser.

Retention Period: If You choose to delete your account, We will retain Your data for a period of up to 7 days. After this 7-day period, Your account and all associated data (including photos, links, and comments) will be permanently deleted from Our systems. However, We may retain certain data and information that We believe is necessary for legal and business purposes, such as legal, tax, and compliance purposes, and to resolve disputes.

Payment Information. Since any payment information is through a third-party, We do not obtain or retain payment account information, only entry of payment being made and the amount of payment. 

4. Sharing of Information

As We are a US-based company, Your personal information will be transferred to and processed in the United States. 

Personal Information. We do not sell your personal information. We may share your personal information with third parties in the following circumstances:

  • Account Creation: With SMS delivery providers (for OTPs) to set up Your account and verify the phone number, and if applicable any email address, You provide Us. These providers are authorized to use Your personal information only as necessary to provide these services to Us.

  • Legal Requirements: Where required by law, court order, or competent authority request, we may disclose personal information to relevant authorities, including US based authorities. We may also share personal information if we reasonably believe We are required to do so by a legal requirement, or that sharing is necessary to comply with a legal obligation. We may also share personal information where reasonably necessary to  protect and defend Our rights or property, or protect the personal safety of users of the Services or the public. We may also share as necessary with our professional advisors, such as lawyers and auditors, who are under a duty of confidentiality.

  • When You Request Us: In an instance where You request that We share, or You consent to Our sharing.

  • Business Transfers: If we are involved in a merger, acquisition, or sale of all or a portion of our assets, Your information may be transferred as part of that transaction.

User Content and Information. We share Your user content and information in the following circumstances:

  • Service Providers: With third-party vendors who assist Us in operating the App and providing services to You or Us, such as cloud hosting services (to store your photos and content), analytics, and customer support tools. 

  • Cross-Border Data Transfer Notice: Google Gemini and similar AI providers We use process and store data on servers located outside of Canada, including in the United States. When your information is transferred internationally, it becomes subject to the laws of the jurisdiction in which it is held, and may be accessible to courts, law enforcement, or national security authorities in that jurisdiction. We take contractual and technical steps to require that any third party processing your data provide a comparable level of protection to that required under United States and Canadian privacy law.

  • Legal Requirements: Where required by law, court order, or competent authority request, we may disclose personal information to relevant authorities. We may also share personal information if we reasonably believe We are required to do so by a legal requirement, or that sharing is necessary to comply with a legal obligation. We may also share personal information where reasonably necessary to  protect and defend Our rights or property, or protect the personal safety of users of the Services or the public. We may also share as necessary with our professional advisors, such as lawyers and auditors who are under a duty of confidentiality.

  • When You Request Us: In an instance where You request that We share, or You consent to Our sharing user content and information..

  • Business Transfers: If We are involved in a merger, acquisition, or sale of all or a portion of our assets, Your information may be transferred as part of that transaction.

5. Children

The App and Our Services are not intended for, and may not be used by, children 13 years of age or younger, with or without parental consent. We do not knowingly collect any personally identifying information from children 13 years of age or younger. If you are a parent or guardian and you are aware that your Child has provided us with personally identifying  information, please contact us. If We become aware that We have collected personal information from a child 13 years of age or younger, we will take steps to remove such information from our files as soon as possible.

6. Security

We take commercially reasonable administrative, physical, and electronic measures designed to protect the information and data that We receive and to protect against loss, misuse, alteration, or unauthorized access or disclosure of the information. These measures include:

  • Standard industry encryption of personal information in transit and at rest.

  • Controls on access and limiting permissions to authorized personnel.

  • Testing and evaluation of technical and organizational security measures.

  • Staff training on data protection and security.

  • Incident response and breach management procedures.

  • Third parties who process personal information on our behalf are contractually required to provide a comparable level of protection. 

However, despite Your and Our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. As such, We cannot guarantee or warrant the security of any information transmitted to Us over the internet and hence We will not be liable for any unintentional disclosure. We encourage You to not share your account login and/or password with any other individual. Your account login and/or password is sensitive and your sharing of your account information may lead to additional exposure to your account.

If We become aware of a security incident that compromises the security of Your personally identifying information, We will take reasonable steps to investigate, mitigate potential harm, and notify You and applicable authorities when required under applicable law.

In the event of a breach with respect to personal information, we will:

  • Notify the competent supervisory authority without undue delay and, where feasible, no later than 72 hours after becoming aware of the breach when the breach is likely to result in a risk to your rights and freedoms.

  • Notify You without undue delay where the breach is likely to result in a high risk to your rights and freedoms, providing information about: the nature of the breach; the categories and approximate number of individuals and records concerned; the likely consequences; and the measures taken or proposed.

  • Maintain an internal record of all data breaches, including those not required to be notified to supervisory authorities.

7. Your Rights and Choices

Depending on where You reside, You may have certain rights regarding Your personal information which may include the following:

Withdrawal Of Consent: You may withdraw Your consent to the permissions and authorizations granted in this Policy and the Terms at any time. However, withdrawal of consent will not affect any prior use and processing of Your personal information.

Right of Access: You may request a copy of Your personal information that We hold and information about how We process it.

Right to Rectification: You may request correction of inaccurate or incomplete personal information.

Right to Erasure:  You may request deletion of your personal information where it is no longer necessary for the purpose collected, where You withdraw consent, or You object to processing, or processing is unlawful.

Right to Restriction: You may request that We restrict processing of your personal information in certain circumstances (e.g., while accuracy is contested).

Right to Object: You may object at any time to processing based on legitimate interests or for direct marketing purposes. We will cease processing unless we demonstrate compelling legitimate grounds overriding your interests.

Right to Portability: Where processing is based on consent to automated means, You may request a copy of your personal information in a commonly used, machine-readable format and have it transmitted to another controller.

Automated Decisions: You have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. Where such processing occurs, you have the right to request human review, express your point of view, and contest the decision.

If you would like to exercise any of these rights, please contact our Privacy Officer at info@everyday-simplified.com. We will respond within one month of receipt of your request. This period may be extended by further two months where requests are complex or numerous, in which case we will notify you.

If You make a request of Us with respect to Your personal information, we may have the legal obligation to first verify Your identity, and may do so and may also request certain information so we can fulfill Your request.

If You are a Canadian resident and You are not satisfied with Our response, you may file a complaint with:

●  Office of the Privacy Commissioner of Canada (OPC) — www.priv.gc.ca.

●  If you are a resident of Quebec: Commission d'accès à l'information du Québec (CAI).

●  If you are a resident of British Columbia or Alberta: the applicable provincial Information and Privacy Commissioner.

8. Privacy  Officer

We are a small company that does not carry out large-scale systematic monitoring of individuals or large-scale processing of special category data.
